Alternative Dispute Resolution
Alternative dispute resolution or ADR increasingly features amongst the range of options available where a dispute needs a solution. That solution is not just recourse to the courts. ADR offers an alternative which seeks to solve the difference between parties efficiently, quickly, and perhaps preserving the relationship between the parties to the dispute in the process.
ADR give parties in dispute the option of also controlling the process and the outcome. While third parties, accredited mediators are involved, their role is not to impose solutions but to assist the parties to reach an agreement.
Even where court proceedings are seen as the only option, the parties are often required first to attempt conciliation or mediation before court proceedings can be issued. In some courts, before a matter gets to trial it must first be mediated.
