When handling estates we may also advertise notice to creditors, to protect the executor from any claims made by creditors of the deceased of whom the executor is not aware.

In the event of there being any possibility of the will being contested by a disgruntled member of the family on the basis that inadequate provision has been made for them in the will, we ensure that the estate is not distributed or finalised within six months of the grant of probate. That person has this time in which to issue proceedings claiming further provision.  An executor who approves a distribution to beneficiaries within the six month period runs the risk of being personally liable for any claim if the disgruntled party is successful in the court proceedings after the estate has been distributed.

We endeavour to administer estates in a prompt and caring manner to ensure that the family of the deceased are not subject to unnecessary stress or hardship.
